These Terms of Service ("Terms") govern your access to and use of Monocle ("Service"), an observability platform based in France ("we", "us", "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Monocle is an observability platform that allows you to collect, store, and analyze logs, traces, and exceptions from your applications. The Service includes:

• Log collection and aggregation
• Distributed tracing
• Exception tracking and management
• Performance monitoring
• Alerting and notifications
• Dashboards and analytics

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Transmit malicious code or attempt to compromise our systems
• Intentionally send personally identifiable information (PII) in logs without proper consent
• Exceed reasonable usage limits or abuse the Service
• Resell or redistribute the Service without authorization
• Interfere with other users' access to the Service

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described therein.

6. Data Retention

Observability data (logs, traces, exceptions) is retained for 90 days from the date of ingestion. After this period, data is automatically deleted. You may request earlier deletion by contacting us.

7. Payment Terms

Payment terms are determined by the subscription plan you select. All payments are processed securely through Stripe. You agree to:

• Pay all fees associated with your selected plan
• Provide valid payment information
• Accept that prices may change with 30 days notice for existing subscriptions

8. Service Availability

We strive to maintain high availability of the Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (with advance notice when possible)
• Emergency maintenance
• Factors beyond our reasonable control

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Monocle and are protected by international copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may terminate your account at any time. We may terminate or suspend your access immediately, without prior notice, for any breach of these Terms.

Upon termination, your right to use the Service will cease immediately. Your data will be deleted according to our retention policies.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of France.
